Personal data

I. General Provisions

  1. The data controller pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”) is PROXIMA LEGAL (hereinafter: “the controller”).

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  4. The controller has not appointed a data protection officer.

II. Sources and categories of personal data processed

  1. The controller processes personal data that you have provided to it or personal data that the controller has obtained on the basis of compliance with a legal obligation, performance of a contract, a legitimate and vital interest, or the data subject’s consent to the processing of personal data.
  2. The controller processes your identification and contact details and data necessary for the personalisation of content, advertising, traffic analysis and the performance of a contract.

III. Legal basis and purpose of personal data processing

  1. Processing of personal data on the basis of the Controller’s legitimate
    interest – in certain cases, the Controller processes personal data to ensure the protection of its rights and legally protected interests, or the rights and legally protected interests of other entities. The Controller may carry out such processing without the data subject’s consent. The Controller always carefully assesses the existence of a legitimate interest.
  2. Processing of personal data based on contractual terms
    – performance of the contract between you and the Controller pursuant to Article 6(1)(b) of the GDPR,
    – the Controller’s legitimate interest in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR,
    - your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the event that no order for goods or services has been placed.
    - processing your order and exercising the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data necessary for the successful processing of the order (name and address, contact details) is required; the provision of personal data is a necessary requirement for the conclusion and performance of the contract; without the provision of personal data, it is not possible to conclude the contract or for the controller to perform it,
  3. The purpose of processing personal data is
    - to process your order and to exercise the rights and fulfil the obligations arising from the contractual relationship between you and the controller; When placing an order, personal data is required which is necessary for the successful processing of the order (name and address, contact details); the provision of personal data is a necessary requirement for the conclusion and performance of the contract; without the provision of personal data, it is not possible to conclude the contract or for the controller to fulfil it,
  4. Processing of personal data based on the consent of data subjects
    – The controller processes personal data on the basis of consent in the cases listed by the controller.
  5. The controller does not carry out automated individual decision-making within the meaning of Article 22 of the GDPR.

IV. Data retention period

  1. The controller retains personal data
    - for the duration of the contractual relationship
    - for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to enforce claims arising from these contractual relationships (for a period of 5 years from the termination of the contractual relationship).
    - until consent to the processing of personal data for marketing purposes is withdrawn, for a maximum of 5 years, where personal data is processed on the basis of consent.
  2. Once the retention period for personal data has expired, the controller will erase the personal data.

V. Recipients of personal data (the controller’s subcontractors)

  1. Recipients of personal data are persons
    involved in the delivery of goods/services/processing of payments under the contract
  2. The controller does not intend to transfer personal data to a third country or an international organisation, and the existence or absence of a Commission decision on adequate protection or, in the case of transfers referred to in Articles 46, 47 or the second subparagraph of Article 49(1), a reference to appropriate safeguards and the means to obtain a copy of such data or information on where such data has been made available.

VI. Cookies

  1. We use ‘cookies’ on our website to provide visitors with a more convenient browsing experience. ‘Cookies’ are small text files that the website creates on your device when you visit it.
  2. Our website uses both ‘session cookies’ and ‘persistent cookies
    ’. - Session cookies allow you to navigate between the various pages of our site and remember any information you enter there. A session cookie is automatically deleted when you close your browser or shortly afterwards.
    - Persistent cookies allow this website to remember your preferences and settings for your next visit, meaning, for example, that you do not have to log in repeatedly. Persistent cookies automatically expire after a set period of time.

    how visitors use it (e.g. which pages are most frequently visited); - enhance the functionality of the website and personalise it for you by allowing us to remember your previous choices. However, this information is not used to identify you or to track your browsing history on the internet
    .- enable certain tools to work, provide anti-spam measures and access to age-restricted content;
    and- allow some of our suppliers to provide services on our behalf in relation to the Website.
  4. “Cookies” are not viruses. They are simply text files that do not contain any programs and, as such, cannot be executed as programs. A “cookie” file cannot copy itself or spread across the internet. However, your web browser sends them to the relevant Website each time you visit, and they are then displayed in your browser settings.
  5. We also use cookies to generally record statistical data on visitor behaviour on this website. This allows us to tailor the site specifically to your interests and requirements.
  6. Cookies help us identify particularly popular or problematic sections of the Website, but they cannot be linked to a specific user.

  8. You can, of course, view this Website without cookies, but some of its functions may be limited and your user experience may be reduced. VII. Your rights

  1. Under the conditions set out in the GDPR, you have
    : - the right of access to your personal
    data pursuant to Article 15 of the GDPR; - the right to rectification of personal data pursuant to Article 16 of the GDPR, or restriction of processing pursuant to Article 18 of the GDPR
    ; - the right to erasure of personal data pursuant to Article 17 of the GDPR;
    - the right to object to processing under Article 21 of the GDPR; and
    - the right to data portability under Article 20 of the GDPR
    .- the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms and conditions, without this affecting the lawfulness of processing based on consent given prior to its withdrawal.
  2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to the protection of personal data has been infringed.

VIII. Conditions for the security of personal data

  1. The controller declares that it has taken all appropriate technical and organisational measures to ensure the security of personal data.
  2. The Controller has taken technical measures to secure data storage facilities and physical storage of personal data, in particular through the use of passwords, antivirus software and backups.
  3. The Controller declares that only persons authorised by the Controller have access to personal data.

IX. Final Provisions

  1. By submitting the online form, you confirm that you are familiar with the terms and conditions of personal data protection and that you accept them in full.
  2. The Controller is entitled to amend these terms and conditions. The new version of the privacy policy will be published on its website.
